Eligibility
The Get Unstuck Contest is eligible to all course entrants between 10/1/18 to 11/15/18 and may be entered by anyone world-wide who is twenty-one years of age or older and is enrolled in the Get Unstuck Course. The judges of the contest, officers , employees, and ex-employees of Equilibrium Enterprises, Inc. and the immediate families of those previously mentioned are not eligible to win. Past winners of the same course and contest are not eligible.
General Rules to Win
Participants enrolled in the course between the dates above must complete the Get Unstuck Course (all course modules, quizzes), positively participate, TRACK A MIN OF 3 HABITS FOR 28 DAYS (Using the free or paid app Habit Factor app, or any Habit Factor branded Habit Tracking Form) and submit a minimum of 450 word essay about the experience OR a minimum two minute video OR, optionally, a contestant may submit BOTH.
Publicity, Privacy & Release
All participants and winner(s) grant Equilibrium Enterprises, Inc. / The Habit Factor exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with any promotion of this and / or other contests and waive any claims to royalty, right, or remuneration or such use.
Release. By participating in the Contest, each participant and winner waives any and all claims of liability against Equilibrium Enterprises, Inc. / (The Habit Factor®), its employees and agents, its respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest or from the use of any prize.
As this is a skills related contest your likelihood to win will be based upon the number of contestants and the quality of the submissions. Equilibrium Enterprises, Inc., may substitute prizes of equivalent value, amend the rules or discontinue the Contest at any time as announced.
Equilibrium Enterprises, Inc., disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. Written copies of these rules are made available online or via email by request. All entries become the property of Equilibrium Enterprises, Inc. and The Habit Factor and will not be returned.
Winner Selection / Notification
Winners will be selected, subject to verification and notified by 12/15/18
The Winner will be required to respond to winner notification and other communications within seven (7) business days or prize may be forfeited.
Winner name(s) may be posted on The Habit Factor’s website (or its social media related sites) at its sole discretion. If prizing is fulfilled by mail, prize will be mailed via regular USPS mail only to such winner’s address i EEI is not responsible for lost or stolen items delivered by mail.
If any prize, prize notification, or Drawing-related communication is rejected, faulty, or returned as undeliverable, if a potential winner does not respond according to the notification’s of Equilibrium Enterprises instructions, or if a winner or potential winner fails to comply with these Official Rules, the prize will be forfeited and an alternate winner may be selected (time permitting) based on the original method of winner selection.
Decisions. By participating in the Contest, participants agree to be bound by the decisions of Equilibrium Enterprises personnel. EEI reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the Contest, or obtained winner status using fraudulent means.
EEI is not obligated to pursue more than three (3) alternate winners for any prize for any reason, in which case a prize may be deemed unclaimed
Compliance
Any valuation of the prize(s) stated above is based on available information provided to Equilibrium Enterprises, Inc., and the value of any prize awarded to a winner may be reported for tax purposes as required by law.
Each winner is solely responsible for reporting and paying any and all applicable taxes.
Equilibrium Enterprises Inc., may disqualify an Entry if it includes any content which, in EEI’s opinion, is otherwise unsuitable in connection with this Contest. EEI reserves the right to reject or disqualify any Entry at any time, in its sole discretion, without incurring any liability.
WARRANTY:
By entering the Contest, each Entrant represents and warrants that (a) any Submission provided with an Entry is original to Entrant and does not infringe upon or otherwise violate any right of any third party, (b) Entrant has all rights necessary to submit any Submission provided, and (c) no Submission includes any restricted content as defined above, or other material that would violate applicable law.
BY SUBMITTING AN ENTRY, EACH ENTRANT FURTHER WARRANTS AND REPRESENTS THAT HIS/HER ENTRY COMPLIES WITH ALL CONDITIONS STATED IN THESE OFFICIAL RULES, AND AGREES THAT THE CONTEST ENTITIES WILL BEAR NO LEGAL LIABILITY TO THIRD PARTIES REGARDING THE USE OF THE ENTRY BY THE CONTEST ENTITIES, AND THAT THE CONTEST ENTITIES SHALL BE INDEMNIFIED AND HELD HARMLESS BY ENTRANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS NOT FULLY COMPLIED WITH ANY OF THE OFFICIAL RULES.
Dispute / Arbitration
Equilibrium Enterprises, Inc. will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest winners. Equilibrium Enterprises, Inc.’s decisions concerning such disputes shall be final.
If the conduct or outcome of the Contest is affected by human error, any mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, intentional interference or any event beyond the control of Equilibrium Enterprises, Inc.
Equilibrium Enterprises reserves the right to terminate this Contest, or make such other decisions regarding the outcome. Equilibrium Enterprises deems appropriate.
All decisions related to the contest and winners will be made by Equilibrium Enterprises, Inc and are final. Equilibrium Enterprises may waive any of these rules in its sole discretion.
Any financial compensation to a participant will not exceed the amount paid to enroll in the course.
Should a dispute arise under or relating to this Agreement, the parties agree to submit such dispute to binding arbitration in the state of California, County of San Diego. The arbitration shall be conducted on a confidential basis pursuant to the then current Commercial Arbitration Rules of the American Arbitration Association.
Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include to the prevailing party an assessment of costs, expenses and reasonable attorneys’ fees. The parties reserve the right to object to any individual who shall be employed by or affiliated with a competing organization or entity. An award of arbitration may be confirmed in any court of competent jurisdiction located within the State of California, County of San Diego.
